Purpose and Scope

These Terms govern access to and use of the jatfleet.com website and the JAT Fleet platform, including all content, features, products, and services made available through them. They apply to any user, visitor, or registered customer, regardless of location or type of use.

Access to the JAT Fleet Platform

Access to the platform may require prior registration, authentication, and the execution of a service agreement. ORBCOM reserves the right to suspend or restrict access to the platform or to certain features for security, maintenance, or operational management reasons.

User Account and Responsibilities

The user is responsible for maintaining the confidentiality of their account access credentials and for all actions carried out through the account. ORBCOM shall not be liable for unauthorized access resulting from negligent sharing or misuse of credentials.

User Obligations

The user undertakes to:

• Use the platform in a lawful, ethical, and diligent manner;

• Not violate or compromise the security of the platform;

• Not use the platform for fraudulent, illegal, or abusive purposes;

• Provide only true, complete, and up-to-date information;

• Respect all intellectual property rights of ORBCOM.

Intellectual Property Rights

All intellectual property rights relating to the software, interfaces, databases, content, trademarks, logos, and documentation associated with the JAT Fleet platform belong to ORBCOM or to duly licensed third parties. Any reproduction, modification, distribution, reverse engineering, or other unauthorized use is strictly prohibited.

Licensing and Subscription

Access to the JAT Fleet platform is subject to a non-exclusive, limited, and non-transferable license agreement. Use is granted through subscription to the applicable plan. Failure to pay within the stipulated deadlines will result in automatic suspension of access. Available features and limits vary according to the active plan. The user may not sublicense, transfer, or resell access to the platform.

Confidentiality

The parties agree to maintain the confidentiality of all technical, commercial, operational, and contractual information accessed during the term of this agreement. Confidentiality obligations shall survive termination of the contractual relationship, except where disclosure is required by law.

Data Export and Retention

Data entered into the platform remains the property of the customer. The customer may export their data at any time through platform functionalities or upon request. Upon termination of the contract, data will be deleted within a maximum period of 90 days, unless a longer retention period is required by law.

Commercial Terms and Billing

Use of the JAT Fleet platform is subject to payment of the fees corresponding to the subscribed plan, in accordance with the commercial conditions agreed between the parties or published on the website.

Failure to comply with payment deadlines entitles ORBCOM to suspend or cancel access to the platform, without prejudice to the collection of outstanding amounts and any legally applicable late payment interest.

ORBCOM reserves the right to amend prices and commercial conditions upon prior notice to the customer, without affecting amounts already invoiced or ongoing subscription periods, unless otherwise agreed.

Warranty and Liability Limitations

The platform is provided “as is” and may include technical limitations, errors, or temporary unavailability. To the maximum extent permitted by law, ORBCOM excludes any liability for indirect damages, loss of profits, data loss, business interruption, or damages caused by third parties or events beyond its control.

Termination and Suspension

ORBCOM may suspend or terminate access to the platform with immediate effect in the event of:

• Breach of these Terms;

• Contractual non-compliance or failure to pay;

• Evidence of abusive, fraudulent, or unlawful use;

Amendments to the Terms

ORBCOM reserves the right to amend these Terms at any time. Amendments will be published on the website with an indication of their effective date. Continued use of the platform after such changes constitutes full acceptance of the revised Terms.

Dispute Resolution

In the event of a consumer dispute, the user may resort to an Alternative Dispute Resolution (ADR) entity, as provided at https://jatfleet.com/resolucao-alternativa-de-litigios/Alternatively, the user may use the European Online Dispute Resolution (ODR) platform.

Applicable Law and Jurisdiction

Estes Termos são regidos pela lei portuguesa. Para resolução de litígios emergentes da interpretação ou execução dos presentes Termos, será competente o tribunal da comarca do Porto, com renúncia expressa a qualquer outro.
